What are the rental terms?

Rental terms quick guide

The following Quick Guide is for the purpose of explaining, in a simple and practical way, some of the conditions our relationship with customers is subjected to. We and our customers undersign a master rental agreement or contract for our production equipment. Said agreement or contract contains the conditions for the rental of filming equipment. The general rules herein expressed may be varied depending on the concrete conditions stipulated in the respective contracts. Therefore, we strongly recommend said contract be carefully read and saved.

About the use of the equipment

Equipments that work well on the set allow us all -producers, technicians and rental company - to leave a good impression. A safe and professional handling of equipments is essential. For such purpose we rely on our customers’ help. Our contract specifically stipulates that equipments must be operated only by qualified technical personnel.

Commercial & Booking Department – Working hours

Monday to Friday from 09.00 AM to 06.30 PM. Booking orders and requests are received, processed and confirmed exclusively during the abovementioned working hours. Requests shall be sent via e-mail or fax.

Limit hour for processing orders and requests

Orders and requests must reach us with as much anticipation as possible in order for us to enter said list into the system, confirm equipment availability, quote the order, prepare it and check it before collection by the lessee. For such purpose, we have set 5.00 PM as the “limit hour” for the reception of those orders and requests to be collected the following day. For those film productions to be carried out on Saturdays, Sundays of Mondays, no orders shall be received after Friday 05.00 PM.

Tests and checking before the shooting

Meeting our customers’ expectations is our priority and we – as well as our clients - share the satisfaction of a successful and smooth filming without setbacks. However, we will not be liable for the performance of the equipment and/or the results of the tasks carried out with said equipment.

The Gaffer, Chief Electrical Technician, Grips and Camera Assistants must check their order the day before the shooting in order to make sure that everything works properly. This is the right moment to check that the whole ordered equipments and materials have been provided by the lessor, as well as the right time for setup modifications and adjustments.

Said checking and testing shall take place exclusively from Mondays to Fridays within working hours, by previous telephone appointment.

Delivering and returning equipment

Our warehouse serves scheduled deliveries and returns 24 x 7 x 365. Out of our regular working hours orders cannot be altered at the moment of being collected by lessee. Therefore, it is important that the equipment be inspected, setup and quantities approved before collection. The loading and unloading of equipments must be carried out by the technical staff. Loading and unloading shall be always supervised by a person in charge appointed by the Gaffer.

Loading and unloading of lighting equipments & grips when transport in provided by lessor

In projects where we supply transport for Lights & Grip, the initial loading and the final unloading of equipments is part of the service we offer. The shifting of equipment during shooting and/or the loading or unloading of additional equipment from the truck for specific situations must be carried out exclusively by the technical staff, with no exceptions whatsoever. Producers shall both coordinate the logistics and appoint the technician for each particular case. They shall also be responsible for the summoning of truck drivers and generator operators.

Collecting and returning camera equipment

Cameras and/or accessories shall always be collected and returned by a member of the camera team. No equipment shall be handled to the transported alone. In shootings taking more than one day, if the vehicle carrying the camera remains parked in our parking area, cameras and lenses must be locked in the box inside our camera facility assigned to that production in particular.

Data, images, programs and software when shooting with digital cameras

When rental includes digital cameras, memory cards, hard discs, computers and laptops, the lessee shall assume exclusive responsibility and liability for the safekeeping and back up of images, programs and software, information, contents and data before the return of the equipment by the lessee. Captured and stored materials shall be formatted by the lessee before equipment is returned.

Our firm shall assume no responsibility for the use, misuse, loss, damage or destruction of images, programs and software, information, contents or data of the lessee stored in any manner in the equipment rented and kept in the capture and storage devices once the equipment is returned.

Storage of third-parties equipment

In the event of the lease of equipments, should the lessee –for logistic reasons– request the storage of equipment/s not belonging to the lessor within the leasing company premises, such storage shall be done under the following conditions : 1º) will be of an extraordinary character and will depend both on the availability of personnel and on the storage capacity of the lessor to store said equipments, the lessor not assuming any liability whatsoever for any theft, breaking or destruction that the stored equipments may suffer; 2º) the service shall be of no cost and in no case will it be deemed a storage contract and therefore the lessor shall assume no liabilities as storer.

Fees during trip days

We charge 50 % of the rental fee per day in case the equipment has to be carried for travel the day before and/or after the shooting.

About our Emergency Service

We offer an Emergency Service out of our regular working hours with the main goal of ensuring our clients technical support in case of difficulties.

Damaged equipment during the shooting

In case any damage, failure or breaking occurred during shooting, please do contact us immediately. Do not attempt any reparation, either yourself or a third party. We shall make all possible efforts to repair or replace the damaged equipment as fast as possible.

Out of hours and emergencies

Out of hours emergencies shall be charged with USD 95/hour plus VAT (for instance, in the cases of unplanned preparation and delivery of critical equipment). Such exception shall not apply in case of failure or replacement of equipment and materials.

Agreement and insurance

All rentals are bound by a Master Agreement on Rental. The equipment and materials are delivered without insurance coverage. It is responsibility of the lessee to contract an insurance policy to cover all the risks assumed under said agreement, assigning the rights of the insurance policy to MUSITELLI FILM & DIGITAL S.A.

How to proceed in the event of robbery or serious damage?

In any of these cases, you must communicate it immediately to our Firm, to your insurance broker and in the event of robbery, report it before the nearest police office.
